In the literature, the term code-mixing/switching refers to instances of language mixing in which speakers/signers combine properties of two or more languages in their utterances. Such a linguistic behavior is typically discussed in the context of multilinguals, and experts commonly focus on the form of language mixing/switching and its cross-linguistic commonalities. Not much is known, however, about how the knowledge of code-mixing comes about. How come any speaker/signer having access to more than one externalization channel (spoken or signed) code-mixes spontaneously? (...) Likewise, why do both neurotypical speakers/signers and certain neuro-atypical speakers/signers produce structurally similar mixing types? This paper offers some answers to these questions arguing that the cognitive process underlying code-mixing is a basic property of the human learning device: recombination, a fully automated cognitive process. Recombination is innate: it allows learners to select relevant linguistic features from heterogeneous inputs, and recombine them into new syntactic objects as part of their mental grammars whose extensions, arguably individual idiolects, represents what Aboh (2015b, a, 2019b) characterizes as hybrid grammars. Locality is a key concept not only in linguistic theorizing, but in explaining pattern of acquisition and patterns of recovery in garden path sentences, as well. If syntax relates sound and meaning over an infinite domain, syntactic dependencies and operations must be restricted in such a way to apply over limited, finite domains in order to be detectable at all. The theory of what these finite domains are and how they relate to the fundamentally unbounded nature of syntax is the (...) theory of locality. The papers in this collection all deal with the concept of locality in syntactic theory, and, more specifically, describe and analyze the various contributions Luigi Rizzi has made to this area over the past three and a half decades. The authors are all eminent linguists in generative syntax who have collaborated with Rizzi closely, and in eleven chapters, they explore locality in both pure syntax and psycholinguistics. I defend constitutivism against two prominent objections and argue that agential constitutivism has the resources to take normative and ethical deliberation seriously. I first consider David Enoch’s shmagency challenge and argue that it does not form a coherent objection. I counter Enoch’s view that the phenomenology of first-person deliberation pragmatically justifies belief in irreducibly realist normative truths, claiming that constitutivism can respect the practice of moral deliberation without appeal to robustly realist truths. Secondly, I argue that the error (...) theoretic worry that all normative judgements are false does not threaten constitutivism ; the objection either fails to shift the burden of proof to constitutivism, or poses justificatory challenges that constitutivism can meet. I conclude that a questionable foundationalism about justification underlies these objections. (shrink)

The central problem of the ‘normativity of law’ concerns how legal rules or directives give us reasons for actions. The core of this question is how something that is external to the agent, such as legal rules or directives, can be ‘part of the agent’, and how they can guide the agent in performing complex actions (such as legal rule-following) that persist over time. David Enoch has denied that the normativity of law poses any interesting challenge to theories of (...) law. He argues that law provides reasons for actions in terms of what he calls triggering-reasons and he advances the view that because there are many circumstances in which reasons are triggered, law does not pose a special challenge. According to Enoch, once we understand the way that triggering reasons operate, we can understand how legal rules and directives provide us with reasons for actions. In §II of this paper, I set the stage for the debate and establish a set of principles that emerge from the common sense of view of reasons for actions and argue that any theory of reasons for action should provide a coherent explanation of these key principles. I focus on the idea that a satisfactory account of reasons for action should also explain reasons in actions. In §III I explain briefly the different theories of reasons for action and locate Enoch’s conception of reasons for action as triggering-reasons within this theoretical framework. The article proposes to discuss the categories of "purity" and "impurity" as tools for structuring reality and constructing identities in the context of Enochic Judaism in the Second Temple period. Investigate them, in a special way, from the Myth of the Watchers narrated in the Book of the Watchers, which composes the apocalyptic literature of 1 Enoch. Both the homogeneity verified in the lineage guaranteed the purity of the race and, consequently, the establishment of the identity, as well as (...) the cosmic subversion, resulting from displacements of pre-established places, structured the notion of impurity. The article presents Enochic Judaism based on research that took place after the 1980s. Enochic Literature is the literary space from which we are led to discussion around the pure and impure as categories of understanding of reality in the perspective of this movement. The article uses the researches of the anthropologist Mary Douglas, to propose an analysis of the Myth of the Watchers and their readings. The article assumes that, in a sense, the plurality perceived in the Second Temple period establishes possibilities of thinking the faith in the history of the Jewish tradition. This apocalyptic movement has influenced other religious movements, among them, the Early Christianity, which is why some religious experiences, whose roots are in the Judeo-Christian tradition, can be better evaluated. If a legal rule tells us to do something, do we thereby have a reason to do it? This remains one of the most basic questions for theoretical and practical reflection on law. It is a foundational question, which many prominent contemporary theorists have discussed, yet the topic remains poorly understood. While many legal positivists have recently sought to “explain normativity”, this is likely a project inconsistent with the basic commitments of legal positivism, and, in any event, thoroughly unnecessary. New light is shed on Leibniz’s commitment to the metaphysical priority of the intensional interpretation of logic by considering the arithmetical and graphical representations of syllogistic inference that Leibniz studied. Crucial to understanding this connection is the idea that concepts can be intensionally represented in terms of properties of geometric extension, though significantly not the simple geometric property of part-whole inclusion. They typically employ a lineal view of causality and overvalue placement of blame as a component of ethical problem solving. This article takes a systems approach to ethical problems and identifies aspects of systems that promote or impede ethical decision making. It is traditionally the role of the storyteller to create a believable narrative, with the reader investing attention into believing the story while the critic dissects the results to ascertain whether the magic (...) works. As Wallace Stevens put it, "we orchestrate a whole history and then imprison ourselves in the score, as if someone else had written it." 1 In the author's note to the second edition (1962) of Wise Blood (1949) Flannery O'Connor makes the point that her novel is a comic novel, yet its comedy does not lessen the depth of understanding it offers concerning the complexity of freedom. 2 The obsession with fate and destiny that swamps her characters, leads the reader into a gothic nightmare where humans in their attempt to re-create themselves dig themselves further into the graves of their dead relatives. For O'Connor free will does not mean one will but many wills conflicting in one man, and she explains the integrity of the central character of Wise Blood, Hazel Motes, as stemming from his vigorous attempts to rid himself of the "ragged figure who moves from tree to tree in the back of his mind."This figure is the Jesus of his grandfather, and it is also the religious preoccupation of the Deep South. Destiny has shaped his features and his character in the mold of his grandfather, and whomever he meets believes he too is a preacher. After establishing the Church Without Christ, like many sons attempting to shake off their origin, Hazel Motes realizes that his new way of behaving is in some sense being controlled [End Page 211] by his past and that he must shake off all vestiges to possess freedom. One might argue that, by eventually blinding himself, Hazel Motes is behaving as a soul who has given into the temptation of purgation, as if this is destiny. But it can be argued that this act is going against destiny, as it is an act that is perhaps trying to persuade God of something, despite the Oedipal connotations.Questioned by his landlady why he blinded himself he says to pay, and when asked to pay for what, he replies it does not matter what. Mrs. Flood is frightened of death, particularly death being one long blind existence, and Hazel Motes is a reminder to her of her destiny. This can be read as a judgment on life also. Yet she eventually decides to take care of him, for both altruistic and materialistic reasons, believing that his widow would inherit his war pension. Mrs. Flood, her name evocative of apocalyptic occurrences and Old Testament punishment, is a critic of the text; the text in this instance is nothing written but rather Motes himself. It seems that Hazel Motes, his name a reference to taking the mote out of one's own eye before you try and take the splinter out of another's, is punishing himself for his previous denial of Christ and for his sins, such as fornication, as with Mrs. Watts the prostitute and Sabbath Hawks, and murder, but also something more primal.After trying desperately to break the curse of his biological inheritance, his wise blood, just like the character Enoch Emery, it forces him to once again take on roles that deny him freedom. Hazel Motes may seem to a contemporary reader as a caricature, the mad preacher/antipreacher of the American South, but as V. S. Pritchett puts it, Hazel Motes is "entirely real" (p. viii). His self-blinding is part of his further alienation from the world, the world he has come back to after the "Great War." O'Connor shows how this watershed in human history was so devastating, Motes's new theology entirely rational. Carruthers presents evidence concerning the cross-modular integration of information in human subjects which appears to support the “cognitive conception of language.” According to this conception, language is not just a means of communication, but also a representational medium of thought. However, Carruthers overlooks the possibility that language, in both its communicative and cognitive roles, is a nonrepresentational system of conventional signals – that words are not a medium we think in, but a tool we think with. "The Natural System" is the abstract notion of the order in living diversity. The richness and complexity of this notion is revealed by the diversity of representations of the Natural System drawn by ornithologists in the Nineteenth Century. These representations varied in overall form from stars, to circles, to maps, to evolutionary trees and cross-sections through trees. They differed in their depiction of affinity, analogy, continuity, directionality, symmetry, reticulation and branching, evolution, and morphological convergence and divergence. Some representations were two-dimensional, (...) and some were three-dimensional; n-dimensional representations were discussed but never illustrated. The study of diagrammatic representations of the Natural System is made difficult by the frequent failure of authors to discuss them in their texts, and by the consequent problem of distinguishing features which carried meaning from arbitrary features and printing conventions which did not. Many of the systematics controversies of the last thirty years have their roots in the conceptual problems which surrounded the Natural System in the late 1800s, problems which were left unresolved when interest in higher-level systematics declined at the turn of this century. In Veronica Rodriguez-Blanco’s thoughtful and important article, “Reasons in Action v Triggering Reasons: A Reply to Enoch on Reason-Giving and Le- gal Normativity,” she explores with great care the nature of reason-giving, in connection with challenging David Enoch’s influential recent work on reason-giving and the law. While Rodriguez-Blanco’s article makes an important contribution to the literature on the best understanding of rea- son-giving and practical reasoning, it is not clear that an approach to rea- sons for action reformed (...) along the lines Rodriguez-Blanco suggests would change or clarify the ultimate question on which she focuses: the way in which legal systems in general or individual legal norms do (or do not) give citizens reasons for action. Large mining projects can generate highly inequitable outcomes, with affected communities bearing the burden of social and environmental costs while economic benefits accrue largely to domestic and foreign metropolitan centres. This raises important ethical and social justice issues, as does the finite nature of mineral resources, which can mean that current generations enjoy the benefits of mining while future generations bear the costs of environmental and social impacts that can continue long after mining ends. During recent decades two broad approaches, (...) voluntary industry initiatives and government regulation, have been employed in attempts to achieve a more equitable distribution of mining’s positive and negative effects. Both have serious drawbacks. Industry initiatives are ultimately voluntary and may be abandoned in tough economic times; they can be highly variable across companies and projects; and they suffer from serious compliance issues. Public regulation can be inflexible, is subject to industry capture, and in many major mineral producing nations a ‘retreat from regulation’ is reducing its relevance. This article considers whether, and under what conditions, a third and emergent instrument, community development agreements, can help overcome the shortcomings associated with industry initiatives and public regulation. It argues that CDAs have considerable potential in this regard, but that communities can encounter significant practical challenges in their negotiation and implementation. In addition, disparities in negotiation power between communities and project developers can result in inequitable agreements, indicating a continued need for government involvement to create a more level ‘negotiation terrain’. Using video to facilitate data collection has become increasingly common in health research. Using video in research, however, does raise additional ethical concerns. In this paper we utilize family therapy data to provide empirical evidence of how recording equipment is treated. We show that families made a distinction between what was observed through the video by the reflecting team and what was being recorded onto videotape. We show that all parties actively negotiated what should and should not go ‘on the (...) record’, with particular attention to sensitive topics and the responsibility of the therapist. Our findings have important implications for both clinical professionals and researchers using video data. We maintain that informed consent should be an ongoing process and with this in mind we present some arguments pertaining to the current debates in this field of health-care practice. (shrink)

The risk of transmission of HIV or hepatitis B from infectious health care workers to patients is low. However, inadvertent exposure causes great concern amongst patients of an infected health care worker.The patients of a Scottish dentist diagnosed hepatitis B e antigen positive were informed by letter of their exposure. A sample of patients was sent a postal questionnaire. Most respondents reported feeling anxious on receiving the letter but almost all thought patients should always be informed following treatment by an (...) infectious health care worker, although the risk was very small.We discuss clinical and ethical factors relating to informing patients following exposure to an infectious health care worker. We suggest that a balance should be struck between patients' wishes to know of risks to which they have been exposed, however small, and the professional view that when risks are negligible, patients need not be informed. In this paper I advance a constitutive argument for the authority of rational norms. Because accountability to reasons is constitutive of rational agency and rational norms are implicit in reasons for action and belief, the justification of rational norms is of a piece with the practice of reasoning. Peter Railton has objected that the constitutive view fails to defend the categorical authority of reason over agents. I respond to his objections, arguing that they presuppose a foundationalist conception of justification that (...) demands a ground for reason's authority outside of the practice of reasoning. This article appeals to Thomas Aquinas in order to offer a construal of the nature of reason arguably preferable to that prominent in the Enlightenment. Thomas’s account neither espouses the notion that reason is devoid of any appetitive influence nor so conflates reason and will as to suggest that thinking becomes essentially a form of willing. His view does respect that the activity of willing is of fundamental import for the life of reason. Since the ultimate object of the will (...) is union with God, it follows that the virtue that specifically promotes the attainment of this end—the virtue of religion—has particular import because it aims at rectifying the will and is the most excellent among the moral virtues. In brief, this virtue promotes the optimal intellectual and moral flourishing of individuals as well as the realization of justice in society. (shrink)
